Local Government Election Signs

Recent legislative change has resulted in change to electoral advertising posters for local government elections.  “Electoral advertising poster” includes a poster displaying electoral advertising made of (a) corflute or (b) plastic or (c) any other material or kind of material prescribed by regulations.  There have not been any other materials prescribed by regulation at this time.

These are now prohibited “on a public road (including any structure, fixture or vegetation on a public road), except in circumstances prescribed in Regulations”. It is currently not intended there be any regulations.

Consequently, corflute and plastic electoral advertising posters for local government elections cannot be affixed to stobie poles, traffic signs, trees etc along a public road.  “Public Road” is defined in the Local Government Act and does usually include the area between a kerb and property boundaries such as a footpath.

The maximum penalty is $5,000 and Council authorised officers are entitled to enforce this.

An owner or occupier of land may decide to affix a corflute or plastic electoral advertising poster to their own property (e.g. their front fence or stand-alone sign in their front yard).

These legislative changes have no impact on the rules relating to State or Federal Elections.
