Proposed Road Closure Packard Street East, Nairne

Council considered a report including a summary of the submissions received at its meeting on 4 September and resolved as follows:

1. Pursuant to Section 10 of the Roads (Opening & Closing) Act 1991 (the “Act”) makes a Road Process Order to close and create a separate title, Packard Street East adjoining Lot 4000 DP 96297 and marked “A” on the Preliminary Plan provided in attachment 2 of this report.

The land will automatically be classified as Community Land when a title is issued. The Local Government Act does not permit the sale of land classified as Community Land. Consideration will be given to an appropriate community use for the land subject to budget availability.

Council acknowledges that the community engagement process for this matter has had some shortcomings which is unfortunate and regrettable.

In turn, that has contributed to a lack of clarity as to what is being proposed and understandably, the raising of concerns by some in the local community.

The community engagement process used for this matter is being reviewed.

It is intended to have that review completed in time to enable a further agenda item to be considered at the next Council meeting on the 4th September.

It is not proposed to proceed with the proposal any further in the interim.

A new community engagement process that is clear and effective including an on-site information forum would need to be undertaken and the community response to that considered before decision making at a Council meeting occurs.

Council undertook community consultation on the proposed Road Closure of Packard Street East Nairne as per the Council report and resolution of 1 May 2017.

At its meeting on 3 July 2017 Council resolved to:

Defer consideration of this item to allow a further four weeks of consultation with a sign erected on the land and consider the matter when the further consultation has been completed with details of any submissions received.

The process Council is considering is a Road Closure under the Roads Opening and Closing Act. In the Council report dated 1 May 2017 it was stated that the intention of closing Packard St East was to sell the land to generate funds for the further development of Byethorne Park.

The current process relates to the road closure with a further report to Council required before a sale is undertaken.



Council Invites Submissions on the Proposal

Any submissions must be made in writing to the Council, PO box 54 Mount Barker SA 5251, WITHIN 28 DAYS OF THIS NOTICE, setting out full details.  Where a submission is made, Council will give notification of a meeting at which the matter will be considered, so that the person making the submission or a representative may attend if so desired.

 Submissions should be marked “Road Closure Packard Street East” and addressed to the Chief Executive Officer, Mount Barker District Council, PO Box 54, Mount Barker SA 5251 or emailed to by 5pm Monday 7 August 2017.
